Available services may vary by plan, quote, agreement, customer environment, technical requirements, or other written arrangement.
Billing
Fees, deposits, setup costs, monthly service charges, hosting fees, usage charges, renewal terms, cancellation terms, and included services may vary by quote, invoice, plan, proposal, agreement, or customer-specific arrangement.
Customer Responsibilities
Customers are responsible for maintaining accurate account information, protecting credentials, managing authorized users, and promptly notifying us of suspected unauthorized access.
Services must be used for lawful purposes and may not be used to distribute spam, malware, phishing content, deceptive material, unlawful content, infringing material, abusive communications, or activity that creates unreasonable security, legal, reputation, operational, or deliverability risk.
Customers remain responsible for the accuracy, legality, ownership, licensing, and suitability of business information, website content, media, logos, data, records, and other materials they provide.
Customers are responsible for providing timely access, credentials, approvals, content, information, and other materials reasonably necessary for Fawkes to perform agreed services.
Some services may depend on third-party hosting providers, domain registrars, email platforms, software vendors, analytics tools, integrations, or other external systems subject to their own terms and availability.
Customers must comply with applicable Fawkes policies, including privacy, anti-spam, abuse, intellectual property, and other service-specific requirements.
Customer Data & Content
Customer-provided content, business information, media, logos, data, and records may be used, processed, hosted, modified, published, or stored by Fawkes as reasonably necessary to deliver, support, secure, troubleshoot, or maintain the services.
Fawkes does not claim ownership of customer-provided business data merely because that information is processed through services we provide.

Customers must have the rights, licenses, permissions, or other authority needed for content, trademarks, images, media, software, data, and other materials they provide for use in connection with Fawkes services.

Unless a separate written agreement provides otherwise, Fawkes does not guarantee uninterrupted availability, specific search-engine rankings, specific marketing results, uninterrupted third-party services, or compatibility with every external platform or technology.
Limitation of Liability
To the maximum extent permitted by applicable law, Fawkes Digital Marketing shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost rankings, lost data, loss of business, deliverability issues, search-engine algorithm changes, third-party outages, or business interruption.
Unless otherwise required by law or a separate written agreement, total liability is limited to the amount paid for the applicable services during the twelve months preceding the event giving rise to the claim.
Governing Law
These Terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law principles.
Unless otherwise required by applicable law or a separate written agreement, disputes shall be resolved in the state or federal courts located in or serving Cullman County, Alabama.
Separate Agreements
A quote, proposal, statement of work, order form, invoice, subscription agreement, hosting agreement, or other written agreement may include additional or different terms for a particular service.
Where a specific written agreement conflicts with these general Terms, the more specific agreement may control to the extent stated in that agreement.
