IPR Complaint Process Rights Protection
01. Complaint Procedure

Submit clear, complete infringement concerns.

If you believe content hosted, displayed, transmitted, or distributed through Fawkes Digital Marketing websites, hosting environments, or digital services infringes your intellectual property rights, please provide a formal written notice to our designated agent with the information below.

Identification

Provide a clear description of the protected work and the specific URL, account, page, file, or location where the alleged infringement appears.

Authorization

Include a physical or electronic signature of the intellectual property owner or a person authorized to act on behalf of the owner.

Good-Faith Statement

Provide a statement confirming your good-faith belief that the disputed use is not authorized by the owner, the owner’s agent, or the law.

Accuracy Statement

Include a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to submit the complaint.

False claim warning

Submitting false or misleading infringement claims may result in legal liability, including under Section 512(f) of the U.S. Copyright Act where applicable.

02. Counter-Notice Procedure

If material was removed by mistake.

If you believe your material was removed or disabled because of mistake or misidentification, you may submit a counter-notice. The counter-notice should include your signature, identification of the removed material, a statement under penalty of perjury, and your consent to the appropriate jurisdiction where required.

Repeat Violations

Fawkes Digital Marketing may restrict, suspend, or terminate services associated with repeated intellectual property violations in accordance with applicable law and service policy.

Review Process

We review properly submitted notices and may remove, disable, restrict, or restore content as appropriate based on the information provided, applicable law, and service policy.
