Fawkes Digital Marketing ("Company," "we," "our," or "us") respects the intellectual property rights of others and expects its users, clients, and partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), it is our policy to respond promptly to claims of copyright infringement committed using our services and/or website.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied, posted, or used in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written notice that includes:

  1. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
  2. Identification of the material you claim is infringing (with sufficient information for us to locate it, such as URLs or account details).
  3. Your contact information, including your full legal name, address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature.

Counter-Notification (Response to a DMCA Notice)

If you believe that material you posted or made available was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent that includes:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal.
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your full name, address, phone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal district court for your judicial district (or the U.S. District Court for the Northern District of Alabama if outside the United States), and that you will accept service of process from the person who filed the DMCA notice or their agent.
  5. Your physical or electronic signature.

Upon receiving a valid counter-notification, we may restore the material in question within 10–14 business days, unless the original complainant notifies us that they have filed a lawsuit seeking to restrain the alleged infringement.

Repeat Infringers

In accordance with the DMCA, it is our policy to terminate accounts of repeat infringers when appropriate.
