Fawkes Digital Marketing is committed to responsible, permission-based communication. This policy helps protect recipients, customers, email reputation, hosted services, and the integrity of our digital-service environment.

01. Consent Protocol

Responsible outreach starts with permission.

Customers using Fawkes Digital Marketing services are responsible for ensuring they have the proper consent, legal basis, or authorization required for any messages, forms, newsletters, or campaigns they send through connected systems.

Permission-Based Messaging

Commercial messages should be sent only to recipients who have requested information, completed a valid opt-in, established a relevant business relationship, or otherwise provided a lawful basis for contact.

Accurate Sender Information

Sender names, reply-to addresses, domains, subject lines, and routing information must be accurate and must not mislead recipients about the identity or purpose of the communication.

Clear Opt-Out Controls

Marketing messages must provide a clear and functional method for recipients to unsubscribe or request that future promotional communications stop.

Protected Recipient Data

Contact lists, consent records, suppression lists, and recipient information must be handled responsibly and protected from unauthorized access, disclosure, resale, or misuse.

02. Prohibited Conduct

Purchased lists, deceptive outreach, and abusive sending are prohibited.

Customers may not use Fawkes services to send unsolicited bulk email, deceptive messages, phishing attempts, fraudulent offers, malicious attachments, harvested-address campaigns, or communications intended to evade filtering, reputation controls, or recipient preferences.

03. Unsubscribe & Suppression Requirements

Opt-out requests must be honored promptly.

Customers are responsible for maintaining suppression lists and preventing recipients who have opted out from being re-added to future marketing campaigns without a new and valid consent event. An unsubscribe request should be processed as soon as reasonably possible and no later than the timeframe required by applicable law.

04. Monitoring & Enforcement

We may investigate complaints and protect service integrity.

Fawkes Digital Marketing may review delivery patterns, complaint activity, bounce rates, block-list events, sender reputation, or other indicators of misuse. We may request documentation of consent, require corrective action, suspend messaging capabilities, restrict an account, or terminate services when violations are confirmed or when continued activity creates a material risk to recipients, infrastructure, or service reputation.

05. Customer Responsibility

Compliance remains the sender’s responsibility.

Customers are responsible for the legality, accuracy, targeting, content, frequency, and recipient selection of messages they send. Fawkes provides technology and support, but customers must follow applicable laws, industry standards, contractual requirements, and recipient preferences.

06. Reporting Spam or Abuse

Report suspected misuse so it can be reviewed.

Reports should include the sender address, sending domain, date and time received, message subject, relevant headers when available, and a description of the concern. Reports are reviewed in good faith and may result in outreach to the sender, additional investigation, service restrictions, or other appropriate action.
